This elaboration is aimed at a presentation of the issues associated with the process of establishing and payments of the compensation for the real estate expropriated for the purposes of the road building based on Polish new statute. The regulations concerning the compensation for the real estate expropriated for the purposes of the road building ruthlessly require the amendment, because quality of them and the lack of the regulation of crucial issues make that they don't fit to legal standards accepted in Poland. However the proper preparation and the handling of the case can much precipitate the payment of the compensation and lead values to increasing, or rather realizing the value of the compensation.

Niniejsza praca ma na celu prezentację zagadnień związanych z procesem ustalenia i wypłaty odszkodowania za nieruchomość wywłaszczoną na cele budowy dróg w świetle obowiązujących przepisów prawnych specustawy drogowej. Przepisy dotyczące odszkodowania za wywłaszczoną nieruchomość drogową bezwzględnie wymagają nowelizacji, ponieważ ich jakość i brak regulacji kluczowych kwestii powoduje, że nie odpowiadają one standardom prawnym przyjętym w Polsce. Jednak odpowiednie przygotowanie i poprowadzenie sprawy może znacznie przyspieszyć wypłatę odszkodowania i doprowadzić do zwiększenia, czy raczej urealnienia jego wartości.
