Purchase of real estate by foreigners in Poland

Przedmiotem pracy jest nabycie przez cudzoziemca nieruchomości w kontekście ustawy o nabywaniu nieruchomości przez cudzoziemców.Rozdział I przedstawia zakres podmiotowy i przedmiotowy obowiązującej ustawy o nabywaniu nieruchomości przez cudzoziemców. W zakresie podmiotowym przedstawia definicję i status cudzoziemca w ustawie. W zakresie przedmiotowym przedstawia pojecie nieruchomości w prawie polskim i pojęcie nabycia nieruchomości w świetle ustawy. W rozdziale tym również przedstawiono wyłączenia stosowania ustawy o nabywaniu nieruchomości przez cudzoziemców, które dotyczą spółek handlowych, dziedziczenia ustawowego i funduszy inwestycyjnych.Rozdział II przedstawia tryb udzielania zezwolenia. Przedstawiono postępowanie i wymogi w sprawie uzyskania zezwolenia, a także wyjątki od stosowania ustawy o nabywaniu nieruchomości przez cudzoziemców.

The subject of the work is the purchase of real estate by foreigners in the context of the law on the purchase of real estate by foreigners.Chapter 1 presents the scope and subject matter of the current law on purchase of real estate by foreigners. In the subject area it presents the definition and status of the foreigner in the law. It also presents the concept of real estate in Polish law and the concept of acquisition of real estate in the light of the Act. Also included in this chapter are exclusions of the application of the law on acquisition of real estate by foreigners, which concern commercial companies, statutory succession and investment funds.Chapter 2 presents the authorization procedure. Proceedings and requirements for obtaining permission, as well as exceptions from the application of the law on acquisition of real estate by foreigners, are also presented.
