The legal character of the protection of business secrecy and undisclosed know-how in Polish and European Union law, taking into account the wording of the Directive (EU) 2016/943 of the European Parliament and of the Council of 8 June 2016 on the protection of undisclosed know-how and business information (trade secrets) against their unlawful acquisition, use and disclosure.

This work is a comparative study on the protection of business secrecy and undisclosed know-how in Polish and European law before and after the adoption of the Directive of the European Parliament and of the Council of 8 June 2016 on the protection of classified know-how and classified commercial information (trade secrets ) against their unlawful retrieval, exploitation and disclosure. In this work the author tries to answer the question of how the adoption of the aforementioned directive will affect the order of protection of business secrets in Poland and the European Union. The conclusion of the work is that the author decides the legal nature of the protection of the company's confidentiality, taking into account the wording of the directive.

Przedmiotowa praca stanowi studium porównawcze dotyczące ochrony tajemnicy przedsiębiorstwa i niejawnego know-how w prawie polskim, i europejskim przed i po uchwaleniu dyrektywy Parlamentu Europejskiego i Rady z dnia 8.06.2016 r. w sprawie ochrony niejawnego know-how i niejawnych informacji handlowych (tajemnic handlowych) przed ich bezprawnym pozyskiwaniem, wykorzystywaniem i ujawnianiem. W opracowaniu tym autor stara się odpowiedzieć na pytanie, w jaki sposób uchwalenie wyżej wymienionej dyrektywy wpłynie na porządek ochrony tajemnicy przedsiębiorstwa w Polsce i Unii Europejskiej. Konkluzją pracy jest rozstrzygnięcie przez jej autora prawnego charakteru ochrony tajemnicy przedsiębiorstwa z uwzględnieniem brzmienia przedmiotowej dyrektywy.
