Aksjologiczne uwarunkowania pozwolenia na broń

Tematem niniejszej pracy są aksjologiczne uwarunkowania pozwolenia na broń. Praca podzielona jest na trzy rozdziały. Pierwszy ma na celu przybliżenie znaczenia wartości w prawie administracyjnym. Ze względu na charakter pracy rozważania te są w znacznym stopniu ogólne. W tej części została podjęta problematyka związana z próbą tworzenia hierarchii wartości oraz ich normatywizacji. Dalsze rozważania prowadzone w pierwszym rozdziale dotyczą z kolei konkretnych wartości determinujących reglamentację dostępu do broni palnej. W rozdziale drugim przedstawione zostały natomiast przesłanki prawnomaterialne, które winien spełnić wnioskodawca chcący otrzymać pozwolenie na broń. Ostatni rozdział stanowi próbę zdekodowania gwarancji procesowych, które chronią realizację wartości determinujących reglamentację dostępu do broni palnej i amunicji. Celem pracy jest opisanie wartości leżących u podstaw reglamentacji dostępu do broni palnej oraz zdekodowanie gwarancji procesowych zapewniających możliwość realizacji tych wartości w procesie wydawania pozwolenia na broń palną. W ramach podsumowania podjęta została próba oceny obowiązujących przepisów w świetle wartości, które powinny być prawnie chronione poprzez reglamentacje dostępu do broni.

Topic of my master's thesis are the axiological conditionality of the gun permit. The work is divided into three chapters. The first is to approximate the importance of values ​​in administrative law. Due to the nature of the work these considerations are to a great extent general. In this section, issues related to the attempt to create a hierarchy of values ​​and their normatization have been taken up. Further considerations in the first chapter concern in turn the specific values ​​that determine the regulation of firearms access. The second chapter presents the substantive requirements for the applicant to obtain a gun license. The last chapter is an attempt to decode process guarantees that protect the value of regulating access to firearms and ammunition. The aim of the paper is to describe the underlying values ​​of firearms regis- tration and the decommissioning of process guarantees ensuring that these values ​​can be realized in the firearms licensing process. As part of the review, an attempt was made to evaluate the legislation in force in the light of the values ​​that should be legally protected through the arms control regimes.
