Management contract and public-private partnership

The ongoing evolution and changes in social life create the necessity of adjusting the forms of administrative actions in order to meet the requirements of the citizens. As a result, it is essential for the administration to seek for alternative solutions such as the management contract and the public-private partnership. The absence of the management contact in Poland is frequently commented in the doctrine as well as the attempt of its replacement by the public-private partnership. In the first chapter of the thesis the basic features and assumptions of the management contract are presented. The second chapter aims at discussing the question of the management contract in Poland. The third chapter refers to the issue of the public-private partnership. The conclusion of the work contains the summary of the topics presented in the thesis

Ciągła ewolucja i zmiany w życiu społecznym powodują konieczność dostosowywania form działania administracji do potrzeb obywateli. Skutkuje to koniecznością poszukiwania przez administracje nowych form działania jakim są umowa administracyjna i partnerstwo publiczno-prywatne. Brak umowy administracyjnej w Polsce stanowi temat wielu dyskusji w doktrynie zarówno jak próba jej zastąpienia za pomocą partnerstwa publiczno-prywatnego. W rozdziale pierwszym pracy zostały przedstawione podstawowe cechy i założenia umowy administracyjnej. Rozdział drugi obejmuje przedstawienie problemu umowy administracyjnej w Polsce, a w rozdziale trzecim zostało omówione zagadnienie partnerstwa publiczno -prywatnego. Zakończenie pracy stanowi podsumowanie zagadnień na przedstawiony temat.
