Zasiedzenie nieruchomości

The bachelor's thesis treats of the acquisitive prescription of the real estate as a method of acquiring property by a possessor who is not a legal owner. The paper consists of four main parts and short conclusion. At the beginning, the notion of the acquisitive prescription was introduced and concepts of subject - object were described. In the next chapter, statutory requirements such as possession and its role, the lapse of a certain period of time and a good faith were presented. The third part raises the acquisitive prescription of the real estate by a State Treasury. The dissertation is enriched by a dozen decisions of the Supreme Court, the Constitutional Tribunal and numerous legal comments.

Praca licencjacka porusza temat zasiedzenia nieruchomości jako pierwotnego sposobu nabycia własności przez nieuprawnionego jej posiadacza. Praca została podzielona na cztery główne części i krótkie zakończenie. We wstępie do pracy zostało opisane, czym jest zasiedzenie oraz wprowadzono podmiot i przedmiot zasiedzenia nieruchomości. W drugiej części znajdują się przesłanki zasiedzenia, takie jak posiadanie i jego rodzaj, upływ czasu oraz zagadnienie dobrej wiary. Trzecia część zawiera skutki zasiedzenia nieruchomości i kwestie wygaśnięcia praw, które dotyczą przedmiotu zasiedzenia. Ostatnia część skupia się na zasiedzeniu nieruchomości przez Skarb Państwa. Praca wzbogacona jest o orzecznictwo Sądu Najwyższego, Trybunału Konstytucyjnego oraz komentarze do zasiedzenia nieruchomości.
