TAJEMNICA PRZEDSIĘBIORSTWA A KNOW-HOW – ANALIZA PORÓWNAWCZA

Celem pracy jest przedstawienie podobieństw, różnic i relacji pomiędzy dwoma pojęciami - tajemnicy przedsiębiorstwa i know-how. W dzisiejszych czasach, konkurencja oparta jest w coraz większym stopniu na innowacyjności. Podstawowym środkiem ochrony informacji przed jej wykorzystaniem przez konkurencję jest zachowanie jej w poufności. Przedmiotem analizy jest sposób w jaki te dwa pojęcia są definiowane i chronione na szczeblu międzynarodowym, unijnym i krajowym. Know-how nie jest definiowane w ustawie o zwalczaniu nieuczciwej konkurencji tak jak tajemnica przedsiębiorstwa. Dlatego, pojęcie to jest definiowane na podstawie brzmienia innych aktów prawych, orzecznictwa i doktryny.

The purpose of M.A. thesis is to present similarities, differences and relations between two concepts - business secret and know-how. Nowadays, competition is increasingly based on innovation. The basic means of protecting the information against its use by competitors is to keep it confidential. The subject of the analysis is the way in which these two concepts are defined and protected at international, EU and national levels. Know-how is not defined in the Act on Combating Unfair Competition, as is the business secret. Therefore, this concept is defined on the basis of the wording of other legal acts, jurisprudence and doctrine.
