(Im)permissibility of Torture: Voices in the Contemporary Ethical Debate

This dissertation is an attempt at framing the question of torture in a possibly broad context pertinent to the contemporary philosophical debate on the subject. Areas of study encompass the social and cultural aspects ,as well as the framework of international legislation and its implications. The work expounds issues discussed by scholars such as Fritz Allhoff, Jeff McMahan, Henry Shue, David Sussman, and Jeremy Waldron that relate to the possibility of justifying the use of torture in idealized cases, the threat posed by institutionalizing torture for liberal democracy, or the problem with defining the term „torture” in both legal and ethical contexts.

Praca jest próbą ujęcia zagadnienia tortur w szerokim kontekście związanym ze współczesną debatą filozoficzna nad tym zagadnieniem. Poruszane obszary dotyczą zarówno aspektu społecznego, kulturowego, jak i ram międzynarodowego prawodawstwa i jego skutków. W pracy przedstawione są zagadnienia szeroko dyskutowane przez badaczy takich jak Fritz Allhoff, Jeff McMahan, Henry Shue, David Sussman, czy Jeremy Waldron, takie jak możliwość uzasadnienia użycia tortur w wyidealizowanych przypadkach, zagrożenie jakie stanowi instytucjonalizacja tortur dla demokracji liberalnej, czy problemy definicyjne związane z terminem „tortury” zarówno w kontekście prawnym jak i etycznym.
