Depositarys action for the benefit of the shareholders of the investment fund

Głównym problemem badawczym pracy jest analiza prawna instytucji wytaczania powództwa przez depozytariusza na rzecz uczestników funduszu inwestycyjnego. Niniejsze opracowanie jest próbą kompleksowego omówienia zarówno charakteru prawnego takiej konstrukcji, jak i samej sytuacji procesowej depozytariusza oraz uczestników funduszu inwestycyjnego. W tym celu omówiono zróżnicowane aspekty powództwa depozytariusza, w oparciu o analizę tekstu normatywnego oraz dorobek nauki prawa. Jedną z głównych tez niniejszej pracy, jest zbliżony charakter konstrukcyjny powództwa depozytariusza na rzecz uczestników funduszu inwestycyjnego z powództwem "actio pro socio".

The main research problem of this paper is the legal analysis of the institution of bringing an action by the depositary for the benefit of the shareholders of the investment fund. This study is an attempt at a comprehensive discussion of both the legal nature of such institution, as well as the procedural situation of the depositary and the shareholders of the investment fund. For this purpose, various aspects of the depositary's action are discussed, based on the analysis of the normative text and the achievements of legal science. One of the main theses of this paper is the similar structural character of the depositary's action for the benefit of the shareholders of the investment fund with the "actio pro socio" institution.
