Paradygmat przyszłych zmian w systemie prawnej ochrony zabytków i opiece nad nimi w Polsce

Autor kreśli dwa możliwe, ale odmienne modele kształtowania porządku prawnego względem zabytków i innych przejawów dziedzictwa kulturowego. Analizuje w tym względzie doświadczenia innych krajów europejskich i rozważa: model kumulatywny, akcentujący bardziej formalny niż materialny aspekt ujęcia materii składającej się na dziedzictwo kulturowe, oraz model funkcjonalny, akcentujący bardziej materialny wymiar tej materii. Uważa, że niezbędne są istotne zmiany w polskim systemie prawnej ochrony zabytków i opiece nad zabytkami oparcie ich na prawodawstwie międzynarodowym przystosowanym do polskiego systemu ustawodawstwa.

The author sketches two possible though different models of shaping the legislation concerning monuments and other manifestations of cultural heritage. He analyses experiences of other European countries in this respect and considers: the cumulative model stressing the more formal than material aspect of the matter making up the cultural heritage, and the functional model highlighting the more material dimension of the matter. He believes that signifi cant changes in the Polish system of legal protection and preservation of monuments are indispensable, as well as basing them on international law adjusted to the Polish legal system.
