The construction notification in administrative procedure

Celem pracy jest przybliżenie istoty zgłoszenia budowy, jako jednej z trzech form reglamentacji budowlanej. Przedstawiony jest zakres przedmiotowy, sposób załatwienia sprawy oraz wymogi, które obligują stronę, czyli inwestora do wykonania. Ukazane są kryteria, jakie budowa musi spełnić, by mogła w odpowiedni sposób zostać zgłoszona do właściwego miejscowo organu administracji architektoniczno-budowlanej. Praca przedstawia również obowiązki inwestora, czyli podmiotu odpowiedzialnego za zapewnienie bezpieczeństwa w trakcie trwania budowy i jej finansowanie. Ponadto podjęto tematykę milczącego załatwienia sprawy przez organ oraz wyrażenie sprzeciwu, czyli wszczęcie postępowania administracyjnego sensu stricte.

The aim of the work is to present the essence of the construction declaration as one of the three forms of building regulations. Presented is the subject scope, method of settling the case and requirements that oblige the site, that is, the investor to perform. There are shown the criteria that the construction must meet in order to be able to be properly notified to the competent local architectural and construction administration authority. The work also presents the responsibilities of the investor, the entity responsible for ensuring safety during the construction and its financing. In addition, the subject of the silent handling of the case by the administrative body, that is, the initiation of administrative proceedings in a strict sense.
