Separation of the regulation of spa communes in Polish law

The aim of this paper is to discuss selected issues concerning the health resort commune, to indicate the separateness characterizing the health resort commune and to distinguish it from other communes.Health resorts are distinguished not only by their health and climate values, but also by a wider scope of tasks and powers vested in them, as well as by the possibility of additional sources of financing through the collection of a climate tax and subsidies from the state budget.In a health resort commune, a health resort committee must be appointed by the commune council, a local spatial development plan must be drawn up, and in order to obtain the health resort's statute, the commune must meet appropriate conditions and criteria.

Celem niniejszej pracy jest omówienie wybranych zagadnień dotyczących gminy uzdrowiskowej, wskazanie odrębności cechujących gminę uzdrowiskową i wyróżniających ją na tle innych gmin. Gminy uzdrowiskowe wyróżniają się nie tylko walorami uzdrowiskowo-klimatycznymi, lecz także szerszym niż zwykła gmina zakresem zadań oraz uprawnień które jej przysługują oraz możliwością dodatkowych źródeł swojego finansowania poprzez pobieranie opłaty klimatycznej oraz otrzymywanie dotacji z budżetu państwa. W gminie uzdrowiskowej obligatoryjnie musi zostać powołana przez radę gminy komisja uzdrowiskowa, sporządzony miejscowy plan zagospodarowania przestrzennego, gmina aby otrzymać statut uzdrowiska musi spełniać odpowiednie warunki i kryteria.
