Characteristics of contracts for the provision of health services concluded by medical staff with healthcare entities based on an analysis of the activities of selected healthcare entities in 2016-2019

W niniejszej pracy przedstawiona została charakterystyka umów o udzielanie świadczeń zdrowotnych zawieranych w dwóch, wybranych przez Autora placówkach leczniczych na terenie województwa opolskiego. Skoncentrowano się na umowach zawieranych z personelem medycznym zatrudnionym na podstawie umów o pracę, a także na umowach zlecenia (świadczenia usług) oraz tzw. kontraktów (umów o udzielanie świadczeń zdrowotnych). Wyodrębniono różnice w treści zwieranych umów, które są istotne dla obydwu stron i pozwalają dostrzec priorytety ze względu na status prawny danej placówki leczniczej (publiczna i prywatna) oraz zasady jej funkcjonowania i finansowania. Celem pracy było zidentyfikowanie istotnych elementów w relacjach: świadczeniobiorca – świadczeniodawca w świetle obecnych uwarunkowań gospodarki rynkowej i konkurencji na rynku świadczeń zdrowotnych. Praca uwzględnia stan faktyczny i prawny na dzień 30 czerwca 2020 r.

This work presents the characteristics of contracts for the provision of health services concluded in two treatment centers selected by the author in the Opolskie Voivodeship. The focus was on contracts concluded with medical personnel employed on the basis of employment contracts, as well as on contracts of mandate (provision of services) and the so-called contracts (contracts for the provision of health services). Differences in the content of concluded contracts have been identified, which are significant for both parties and allow to see priorities due to the legal status of a given medical facility (public and private) as well as the principles of its functioning and financing. The purpose of the work was to identify significant elements in the relationship: recipient - provider in the light of current conditions of market economy and competition on the health services market. The work takes into account the factual and legal status as at June 30, 2020.
