Strengthened presidency as a manifestation of the rationalization of the parliamentary system in the Third Republic of Poland against the background of development tendencies of Polish and European constitutionalism

The subject of this work is the problem of the strengthened presidency in the context of the rationalization of the parliamentary system. The work presents the shape of presidencies adopted on the basis of European and Polish constitutional solutions in a cross-sectional way. The first chapter presents the concept of rationalization, its various forms, with particular emphasis on rationalization as a strengthened presidency. There are presented the constitutional solutions of the Weimar Republic, the French Republic, Finland and Romania. The second chapter aims at presenting Polish solutions in the field of presidential power from the period of the Second Republic of Poland. There are presented relations between the authorities, attempts at rationalizing the system by means of a strengthened executive and the executive power. The third chapter presents the constitutional basis for the revival of the office of President in the Third Republic of Poland. Next, are shown the relations between the main authorities with an indication of the office of president in the Constitution of 1997. The chapter ends with a cross-sectional analysis of the functioning of the presidency in the Third Republic of Poland and the possible models of the functioning of this office under the current Basic Law adopted by successive presidents.

Tematem pracy jest problem wzmocnionej prezydentury w kontekście racjonalizacji systemu parlamentarnego. W pracy, w sposób przekrojowy zostaje ukazany kształt prezydentur przyjętych na gruncie europejskich i polskich rozwiązań konstytucyjnych. W rozdziale pierwszym przybliżone zostaje pojęcie racjonalizacji, jej różne formy, ze szczególnym uwzględnieniem racjonalizacji jako wzmocnionej prezydentury. Przedstawione zostają rozwiązania konstytucyjne Republiki Weimarskiej, V Republiki Francuskiej, Finlandii, a także Rumunii. Rozdział drugi ma na celu ukazanie polskich rozwiązań w zakresie władzy prezydenckiej z okresu II Rzeczpospolitej. Przedstawione zostaną relacje pomiędzy władzami, próby racjonalizacji systemu za pomocą wzmocnionej egzekutywy, a także władzy wykonawczej. Rozdział trzeci przedstawia konstytucyjne podstawy odrodzenia urzędu prezydenta w III RP. Następnie ukazane zostają relacje między głównymi organami władzy, z wyszczególnieniem urzędu prezydenta w Konstytucji z 1997 roku. Rozdział kończy przekrojowa analiza funkcjonowania prezydentury w III RP i przyjmowane przez kolejnych prezydentów możliwe modele funkcjonowania tego urzędu na gruncie obecnie obowiązującej ustawy zasadniczej.
