Capabilities approach by Martha Nussbaum and legislation & human rights

W niniejszej pracy omówiono teorię zdolności przedstawioną przez Marthę Nussbaum i jej implikacje na gruncie prawa. Teoria ta stanowi koncepcję sprawiedliwości według amerykańskiej filozof i opiera się o filozofię Arystotelesa, Johna Rawlsa i ekonomiczne ujęcie zdolności zaprezentowane przez Amartyę Sena. Jednocześnie jednak ma również charakter deklaracji politycznej i wykazuje daleko idące podobieństwo do systemu praw człowieka. W pierwszej części pracy przedstawiono źródła i główne założenia teorii. W dalszej kolejności krótko scharakteryzowano współczesne prawodawstwo dotyczące praw człowieka. Przedstawienie tych dwóch zagadnień daje asumpt do ustalenia, jaka jest relacja teorii zdolności i praw człowieka oraz jak koncepcja Marthy Nussbaum może wpłynąć na działania legislacyjne.

The thesis addresses the issue of a capabilities approach presented by Martha Nussbaum and its ramifications in the area of law. The approach forms an idea of justice by American philosopher and is based on Aristotle's and John Rawls' philosophy, as well as on economic spin of capabilities presented by Amartya Sen. The capabilities approach is also a political declaration and shows far-reaching resemblance to human rights system. First part of the thesis is a characteristics of approach's references and main tenets. Sequentially the thesis presents contemporary human rights system. It enables to determine the relation between capabilities approach and human rights as well as the way of Nussbaum's idea may influence legislation.
