Concepts of transferring rights from a blank promissory note

The subject of this Master's thesis is to discuss ways of transferring rights from a blank promissory note, with particular emphasis on the situation prior to supplementing the document with the elements referred to art. 1 in connection with art. 2 and art. 101 in connection with art. 102 of the bill of exchange law.The first chapter presents the historical outline of the shaping of the bill of exchange institution itself, including the blank promissory note. The second chapter discusses two ways of transferring rights (by way of endorsement and by assignment), taking into account the charges that the debtor (bill drawer or merchant) is entitled to. In the third chapter, the author presents the mechanism of transferring rights from a blank promissory note and decides whether endorsement and assignment are alternative methods of transferring rights from a blank promissory note.

Przedmiotem niniejszej pracy magisterskiej jest omówienie sposobów przeniesienia praw z weksla in blanco, ze szczególnym uwzględnieniem sytuacji sprzed uzupełnienia dokumentu o elementy, o których mowa w art. 1 w zw. z art. 2 oraz art. 101 w zw. z art. 102 prawa wekslowego.W rozdziale pierwszym przedstawiono rys historyczny kształtowania się samej instytucji weksla, w tym instytucji weksla in blanco. Drugi rozdział stanowi omówienie dwóch sposobów przeniesienia praw (w drodze indosu oraz w drodze przelewu) z uwzględnieniem zarzutów, które przysługują dłużnikowi (wystawcy lub akceptantowi). W trzecim rozdziale Autorka pracy przedstawia sam mechanizm przeniesienia praw z weksla in blanco oraz rozstrzyga, czy indos oraz przelew stanowią alternatywne metody przenoszenia praw z weksla in blanco.
