"The legitimacy of psychiatric detention in the Polish penal code from a perspective of constitutional comparative law studies".

Niniejsza praca ma na celu przedstawienie karnoprawnej problematyki detencji psychiatrycznej. Na wstępie zostały wyjaśnione podstawowe pojęcia związane z detencją psychiatryczną i problematyką jej orzekania. Następnie analizie poddano przepisy z ustawy o postępowaniu wobec osób z zaburzeniami psychicznymi stwarzających zagrożenie życia, zdrowia lub wolności seksualnej innych osób oraz związaną z nią problematykę podwójnej karalności. W dalszej części omówione zostały stanowiska Rzecznika Praw Obywatelskich oraz Europejskiego Trybunału Praw Człowieka i Obywatela. Na końcu pracy przedstawione zostały rozważania komparatystyczne, a więc zostały omówione rozwiązania prawne dotyczące detencji psychiatrycznej, które obowiązują w innych krajach oraz propozycje projektu zmian przedmiotowej ustawy.

The aim of this dissertation is to present and analyse the issues of psychiatric detention in the criminal law. Initially, the basic notions involved with the psychiatric detention were explained as well as problems associated with sentencing and executing in such cases. Furthermore, there were analysed legal regulations from the Law on proceedings against people with psychiatric disorders posing a threat to other people's life, health or sexual freedom and involved with it issues of dual criminality. In the following part there were discussed the attitudes of The Spokesman for Human Rights and European Court of Human and Civil Rights. Finally, some comparative considerations were discussed, namely legal solutions concerning psychiatric detention which are applied in other countries as well as some projects of modifications of the bill.
