Deputies' and Senators' information rights and the right of access to public information

The following analysis "Deputies' and Senators' information rights and the right of access to public information" consider individual parliamentarian powers granted on the Act on Exercising the Mandate of a Deputy and Senator. The purpose of the study was to investigate the deputies' information rights and indicate its incomplete regulation. The major defect in the construction of the act is the lack of formal enforcement procedure. The study focused on non-application to the right of access to public information by deputies as an alternative. The admittance on the grounds of the Act on Access to Public Information is granted to everyone as a transparency sign of public authority. It was found that differences are between the right of access to public information and deputies' information rights. In order to increase the effectiveness of the individual rights of deputies and senators, the amendment is proposed similar to the procedure applied to the Act on Access to Public Information.

Poniższa praca „Uprawniania informacyjne posłów i senatorów a prawo dostępu do informacji publicznej” traktuje o indywidualnych uprawnieniach parlamentarzystów przyznanych ustawą o wykonywaniu mandatu posła i senatora. W pracy dokonano analizy uprawnień oraz ukazano ich niepełne uregulowanie. Największą wadą konstrukcyjną omawianych uprawnień stanowi brak procedury służącej do ich egzekwowania. W tym zakresie celem pracy było wskazanie niezastosowania prawa dostępu do informacji publicznej przez deputowanych jako alternatywy. Prawdo dostępu do informacji publicznej zostało na gruncie ustawowym przyznane każdemu jako przejaw transparentności działań władzy publiczne. Wskazano różnice prawa dostępu do informacji publicznej względem uprawnień informacyjnych deputowanych. Dla zwiększenia efektywności zastosowania indywidualnych uprawnień informacyjnych posłów i senatorów, zaproponowano zmianę ustawy w tym zakresie na podobieństwo procedury zastosowanej w ustawie o dostępie do informacji publicznej.
