The challenges of translating legal and official texts. Example of the Treaty on the Functioning of the European Union in French, Polish, English and Portuguese

Ce mémoire de licence se concentre sur l’analyse des enjeux de la traduction juridique et officielle. La partie théorique présente le multilinguisme au sein de l’Union Européenne et le rôle des traducteurs et des jurilinguistes. Ensuite l’auteur aborde brièvement les différents aspects du discours juridique afin de démontrer les particularités de ce type de discours aussi bien que ses liens avec l’aspect normatif qui fait l’objet des analyses effectuées par les juristes. La partie pratique est une étude comparative des exemples choisis dans quatre versions linguistiques du traité sur le fonctionnement de l’Union Européenne : française, anglaise, polonaise et portugaise. La comparaison a été effectuée sur les niveaux morphosyntaxique, stylistique, terminologique et formel.

This thesis presents an analysis of challenges in legal translation. The theoretical describes the multilingualism in the European Union as well as the role of the translators and jurilinguists. Later we briefly address the legal discourse in order to show its particularities and its connection with the normative aspect. The practical part is a comparative study of exemples from the Treaty on the Functioning of the European Union in four different language versions: French, English, Polish and Portuguese. The analysis includes in particular their morphosyntactic, stylistical, lexical and formal aspects.

Niniejsza praca licencjacka ma na celu analizę wyzwań związanych z tłumaczeniem prawnym i oficjalnym. W części teoretycznej przedstawiona zostałą wielojęzyczność w Unii Europejskiej oraz rola tłumaczy i jurilingwistów. Następnie omówione zostały pokrótce różne perspektywy dyskursu prawnego, aby wykazać jego specyfikę, jak również jego powiązania z aspektem normatywnym, który jest przedmiotem analiz prawniczych. Część praktyczna opiera się na porównaniu wybranych przykładów czterech wersji językowych Traktatu o funkcjonowaniu Unii Europejskiej: francuskiej, angielskiej, polskiej i portugalskiej. Analiza porównawcza została przeprowadzona na poziomie ich morfoskładni, aspektów stylistycznych, leksykalnych oraz formalnych.
