Pozycja Rady Ministrów w polskim porządku ustrojowym

Celem pracy magisterskiej jest charakterystyka pozycji ustrojowej Rady Ministrów w polskim porządku prawnym, poprzez przeprowadzenie badań od momentu kreacji rządu, po wypełnianie obowiązków przez członków Rady Ministrów, a także odpowiedź na pytanie jakie organy wpływają na funkcjonowanie i kontrolę Rady Ministrów oraz czy postulowane przez polityków zmiany, dotyczące wzmocnienia kontroli nad rządem są słuszne.Metodą badawczą było przeanalizowanie literatury oraz ustaw związanych z organizacją oraz funkcjonowaniem Rady Ministrów.Praca magisterska została podzielona na wstęp, zakończenie oraz pięć merytorycznych rozdziałów:Rozdział I zawiera: wyjaśnienie pojęcia Rady Ministrów, charakterystykę zasad konstytucyjnych, które mają kluczowe znaczenie dla pozycji rządu w polskim porządku ustrojowym, a także opis klasycznych modeli systemów rządów prawa.Rozdział II skupiony jest wokół tematyki związanej z powoływaniem rządu oraz procedurą zmian, jakie mogą zachodzić w składzie Rady Ministrów.Rozdział III obejmuje członków wchodzących w skład Rady Ministrów: Prezesa RM, wiceprezesów, ministrów oraz przewodniczących Komitetów Rady Ministrów. Ten rozdział szczegółowo opisuje zakres uprawnień i obowiązków poszczególnych członków rządu.Rozdział IV obejmuje swoim zakresem tematykę związaną z kontrolowaniem rządu przez parlament oraz odpowiedzialnością członków Rady Ministrów.Rozdział V wskazuje na relacje jakie zachodzą pomiędzy Radą Ministrów a pozostałymi organami państwa.

The aim of the master's thesis is to characterize the political position of the Council of Ministers in the Polish legal order by conducting the research from the moment the government is shaped to the fulfilment of duties by members of the Council of Ministers, as well as to answer the question which bodies influence the functioning and control of the Council of Ministers, and whether the changes postulated by politicians regarding strengthening the government control are right.The research method was to analyze literature and laws related to the organization and functioning of the Council of Ministers.The master's thesis consists of an introduction, conclusion and five substantive chapters:Chapter I contains: an explanation of the concept of the Council of Ministers, characteristics of the constitutional principles that are of key importance for the position of the government in the Polish political system, as well as the description of classic models of the rule of law systems.Chapter II is focused around the topics related to the appointment of the government and the procedure of changes that might occur in the composition of the Council of Ministers.Chapter III covers the members of the Council of Ministers: The Prime Minister, vice Prime Ministers and chairmen of the Committees of the Council of Ministers. This section describes the rights and obligations of individual members of the government.Chapter IV covers the topics related to the control of the government by parliament and the responsibility of the members of the Council of Ministers.Chapter V indicates the relations that occur between the Council of Ministers and other state organs.
