The institution of assessor in the light of establishing social factor in Criminal Procedure Law

Niniejsza praca ma na celu ukazanie procesu formowania się czynnika społecznego w procedurze karnej. Ponadto analizie zostały poddane postulaty zmierzające do modyfikacji przedmiotowej instytucji. Opracowana została także tematyka novum w sądownictwie jakim jest wprowadzenie ławników do Sądu Najwyższego oraz ocena koncepcji powrotu do sądów przysięgłych. Praca opiera się na analizie orzecznictwa SN, TK oraz ugruntowanych stanowiskach doktryny przedstawionych przez praktyków i teoretyków prawa.

This master thesis aims at explaining the process related to the establishment of the social factor in Criminal Procedure Law and the factors that have an impact on this concept. In this regard, part of the thesis deals with the reform of the judiciary that has turned assessors into lay judges of the Chamber of the Supreme Court. An assessment of a possible reestablishment of jury courts is provided as well. The thesis relies on the case law of the Supreme Court and the Constitutional Court, while also taking into consideration the theories advanced by legal scholars and practitioners.
