Ograniczenia autonomii woli stron w prawie cywilnym

The main theme of the thesis is an aspect of limitations of the parties' autonomy. In the first part of the thesis the historical outline has been presented - historical sources of limitations of parties' autonomy and classification of these limitations. In the second part of the thesis author has presented legal institutions that shows limitations of parties' autonomy. Theory of polish civil law and polish case law have been presented as to describe the essence of limitations of parties' autonomy. The main aim of the thesis was to show how relevant is to respect rules of parties' autonomy.

Praca dotyczy ograniczeń autonomii woli stron w prawie cywilnym. W pierwszej części przedstawiono rys historyczny - genezę ograniczeń autonomii woli stron, a także dokonano klasyfikacji ograniczeń. W drugiej części pracy zanalizowane zostały instytucje prawne ograniczające autonomię woli stron. Scharakteryzowano poglądy doktryny i orzecznictwa dotyczące ograniczeń autonomii. Poprzez analizę ograniczeń autonomii woli stron, praca miała na celu uświadomić powagę i konieczność respektowania zasady autonomii woli stron w prawie cywilnym.
