Frequency management in telecommunications law

Przedmiotem niniejszej pracy jest analiza międzynarodowych i polskich regulacji telekomunikacyjnych w zakresie zagadnienia gospodarowania widmem radiowym. Treść pracy obejmuje wyjaśnienie pojęcia częstotliwości i jej charakteru prawnego oraz pojęcia gospodarowania częstotliwościami, jego ratio legis, historii i zasad. W dalszej części omawiany jest system źródeł prawa regulujących gospodarowanie widmem, z uwzględnieniem prawa międzynarodowego, prawa Unii Europejskiej i prawa polskiego.Kolejna część pracy to omówienie struktury organów unijnych i krajowych biorących udział w gospodarowaniu częstotliwościami wraz z ich kompetencjami.Ostatnie dwa rozdziały pracy poświęcone są instrumentom indywidualnym zarządzania widmem: pozwoleniu radiowemu, pozwoleniom czasowym, rejestrowi urządzeń radiowych używanych bez pozwolenia oraz rezerwacji częstotliwości. W tym kontekście omówione są kwestie ich charakteru prawnego oraz regulacji dotyczących przesłanek ich wydania, uchylenia i zmiany, ich treści, a także przebiegu postępowań administracyjnych z nimi związanych.

The subject of this thesis is an analysis of the international and Polish telecommunications regulation on the matter of radio spectrum management. The thesis includes an explanation of the concept of frequency and its legal nature, as well as the concept of frequency management, its ratio legis, history and principles. In the next part, sources of law of spectrum management are discussed, including the international law, the law of the European Union and the Polish law.Another section covers the structure of the administrative bodies within both the EU and Poland, that take part in frequency management, as well as the extent of their administrative competence.The final two chapters are dedicated to the individual instruments of spectrum management: a radio licence, short-term licences, a register of radio equipment used without a licence and a frequency reservation. These chapters cover problems such as the legal nature of those instruments and regulations that deal with preconditions of issuance, variation and revocation of such, their content, as well as the administrative procedures related to them.
