Adaptation of Thomas Kuhn’s concept for crim-inal proceedings

This paper attempts to adapt the concept developed by Thomas Kuhn in his book “The Structure of Scientific Revolutions” for criminal proceedings. The author hereof discusses the notion of a paradigm, this being crucial for Kuhn, and dynamics of a paradigm shift, with a contradictory and inquisi-tional model of a criminal procedure serving as an example, and tries to an-swer the question whether the nature of procedural criminal law is revolu-tionary or evolutionary.

Przedmiotem artykułu jest próba adaptacji koncepcji Thomasa Kuhna uję-tej w dziele „Struktura rewolucji naukowych” dla postępowania karnego. Au-torka omawia kluczowe dla Kuhna pojęcie paradygmatu, dynamikę jego zmienności na przykładzie kontradyktoryjno-inkwizycyjnego modelu procesu karnego oraz usiłuje odpowiedzieć na pytanie, czy charakter prawa karnego procesowego jest rewolucyjny, czy może ewolucyjny.
