Change of the name of a legal person of the Catholic Church pursuant to art. 73 of the Law of May 17, 1989, on the Relation Between the State and the Catholic Church in the Republic of Poland

The Law of May 17, 1989, on the Relation Between the State and the Catholic Church in the Republic of Poland provides in art. 73 paragraph 1 possibility of changing the name of individual legal entities listed in its articles 6-9 and possibility of changing the name used to describe the group of organizational units of the Catholic Church that may obtain legal personality on its basis. In addition, in art. 73 paragraph 2 a regulation was introduced on the announcement of such a change in the state promulgator. The existing regulation creates some interpretation and practical problems, in particular as regards the scope of application, terminological consistency and the impact of the announcement in the state official journal on the effectiveness of the name change. De lege ferenda, consideration should be given to changing this regulation, in particular as regards the change of name of the group of organizational units of the Catholic Church and determination of the nature of the name change announcement in the state promulgator.

Ustawa z dnia 17 maja 1989 r. o stosunku Państwa do Kościoła Katolickiego w Rzeczypospolitej Polskiej przewiduje w art. 73 ust. 1 możliwość zmiany nazwy poszczególnych osób prawnych wymienionych w jej art. 6-9 oraz zmiany nazwy używanej dla określenia grupy jednostek organizacyjnych Kościoła Katolickiego, które mogą uzyskać osobowość prawną na jej podstawie. Dodatkowo w art. 73 ust 2 wprowadzono regulację o ogłoszeniu takiej zmiany w państwowym promulgatorze. Istniejąca regulacja stwarza pewne problemy interpretacyjne i praktyczne, w szczególności co do zakresu zastosowania, spójności terminologicznej oraz wpływu ogłoszenia w państwowym dzienniku urzędowym na skuteczność zmiany nazwy. De lege ferenda należałoby rozważyć zmianę przedmiotowej regulacji, w szczególności w odniesieniu do zmiany nazw grupy osób prawnych oraz jednoznaczne przesądzenie charakteru ogłoszenia zmiany nazwy w państwowym promulgatorze.
