This article discusses fundamental ethical dilemmas of court interpreters, arising from their indeterminate identity and thus their social role as well. Although Codes of Ethics have been in place in many countries for years, and are supposed to serve as guidelines for professional practice, they are too general to relate to real situations a court interpreter comes to face. What’s important, when entering the courtroom, the interpreter comes into a specific arrangement with no space planned for a linguistic intermediary. Moreover, the courtroom is a kind of a theatre in itself, its actors provided by the society with props and costumes. The interpreter who is to speak other people’s words, becomes an actor in the process, although social conventions do not provide for the roles of a speaker and an interpreter to be separated. At the same time, the interpreter must deal with various, often contradictory expectations of the participants of court proceedings which may violate the ethics of the interpreter’s profession. This is why adequate professional training and practising ethical sensitivity of interpreters are of vital importance.

W niniejszym artykule omówiono zasadnicze dylematy etyczne tłumaczy sądowych wynikające z niedookreślonej tożsamości, a co za tym idzie roli społecznej tłumacza. Choć od lat w wielu krajach tworzone są kodeksy etyczne, które mają być drogowskazem w praktyce zawodowej, są one na tyle ogólne, że trudno je odnieść do rzeczywistych sytuacji, z którymi styka się tłumacz sądowy. Co istotne wchodząc na salę rozpraw, tłumacz wchodzi w kreślony układ, w którym nie przewidziano miejsca dla pośrednika językowego. Ponadto sala rozpraw sama w sobie jest swoistym teatrem, którego „aktorów” społeczeństwo wyposażyło w rekwizyty i kostiumy. Tłumacz, który ma wypowiadać cudze kwestie, sam staje się aktorem, choć konwencje społeczne nie przewidują całkowitego rozdzielenia ról mówcy i tłumacza. Jednocześnie tłumacz musi się zmagać z różnymi, nierzadko sprzecznymi, oczekiwaniami uczestników postępowania sądowego, które mogą naruszać zasady etyczne wykonywania zawodu tłumacza, stąd tak ważne jest odpowiednie przygotowanie do zawodu i trening wrażliwości etycznej tłumacza.
