Temporary arrest in a psychiatric facility

The subject of the master’s thesis is temporary arrest in a psychiatric facility. International and domestic standards of the temporary arrest as well as the rationale to implementing this precautionary measure have been examined. Attention has been directed at the double status of the detainee - as a person deprived of freedom and as a patient. Moreover, the matter of psychiatric evaluation has been analysed and the topic of applying temporary arrest in the event of implementing a preventive measure which involves committing a person in a closed psychiatric facility has been described. The thesis is based upon the analysis of legal acts as well as the standpoints of the doctrine presented by both practitioners and theorists of law as well as the representatives of the medical community.

Tematem przedmiotowej pracy magisterskiej jest tymczasowe aresztowanie w zakładzie psychiatrycznym. Analizie poddano międzynarodowe i krajowe standardy tymczasowego aresztowania oraz przesłanki wykonywania tego środka zapobiegawczego w zakładzie psychiatrycznym. Zwrócono uwagę na podwójny status aresztanta - jako osoby pozbawionej wolności oraz pacjenta. Ponadto, przeanalizowano problematykę ekspertyzy psychiatrycznej oraz przybliżono kwestię wykonywania tymczasowego aresztowania w wypadku orzeczenia środka zabezpieczającego, polegającego na umieszczeniu osoby w zamkniętym zakładzie psychiatrycznym. Praca opiera się na analizie aktów prawnych oraz stanowisk doktryny przedstawionych przez praktyków i teoretyków prawa oraz przedstawicieli środowisk medycznych.
