Instytucja zażalenia w świetle nowelizacji z 4.7.2019 r. w ujęciu prawnoporównaczym

The study concerns the institution of a complaint and the form given to it after the amendment of the Polish Civil Procedure of 2019. As a result of the above-mentioned amendment, the concept of a horizontal complaint was extended. As emphasized in the doctrine, the legislator in this respect was quite inconsistent, which may lead to potential problems.

Opracowanie dotyczy instytucji zażalenia oraz nadanej mu formy po nowelizacji KPC z 2019 r. W wyniku wspomnianej nowelizacji rozszerzono pojęcie zażalenia poziomego. Jak podkreśla się w doktrynie, ustawodawca w tym zakresie był dosyć niekonsekwentny, co może prowadzić do potencjalnych problemów.
