Prawna ochrona zwierząt czy prawa zwierząt? Teoria abolicjonizmu Garyego Francione

The aim of this thesis is the presentation of the assumptions and postulates of the abolitionist theory of animal rights, based on the views of the American philosopher and lawyer Gary Francione, and contrast them against the theory of animal welfare. The thesis includes in-depth reflections on the status of animals in contemporary society and their place in a legal order. The essential question of the entire thesis is if sentient beings, as animals should be considered to be without any doubts, can be the subject of property with all the social and legal consequences. The thesis has a cross-sectional character, and the problems that it raises are situated on the border of philosophy and law.

Celem niniejszej pracy jest przybliżenie założeń i postulatów nurtu abolicjonistycznego w teorii praw zwierząt w oparciu o poglądy amerykańskiego filozofa i prawnika Gary'ego Francione i przeciwstawienie ich teorii dobrostanu zwierząt. Praca zawiera pogłębioną refleksję nad statusem zwierząt we współczesnym społeczeństwie, a także nad ich miejscem w porządku prawnym. Zasadniczym pytaniem jakie przewija się w całej pracy jest pytanie czy istoty czujące, za jakie niewątpliwie należy uznać zwierzęta, mogą być przedmiotem własności ze wszystkimi tego konsekwencjami społecznymi i prawnymi. Praca ma charakter przekrojowy, a poruszone w niej problemy są problemami głównie z pogranicza filozofii i prawa.
