CONSTITUTIONAL POSITION OF THE HEAD OF STATE OF THE REPUBLIC OF POLAND AND RUSSIAN FEDERATION

The present work focuses on getting acquainted with the systemic positions of the Head of State of the Republic of Poland and the Head of State of the Russian Federation on the basis of the currently binding Constitutions. The premise is to present the differences as well as the similarities between selected aspects of these items' activities. The specific countries were chosen because of the similar time of the beginning of the systemic transformation and the two different paths of development of the office in question that they followed. Chapter one provides a comparison, as well as a general description of the two presidencies. An attempt has been made to place them in specific positions of state systems through the analysis of selected articles of the relevant Constitution. The elections in the two countries were then presented, characterized and compared. The last chapter is devoted to the analysis of the relationship between the office of the President and the various state organs. In the case of the President of the Republic of Poland, his relationship with the Sejm and the Senate, the Courts and Tribunals, and the Government and the Administration are described. The relations of the President of the Russian Federation with Russian state bodies are also described in an analogous way.

Niniejsza praca skupia się na zapoznaniu z pozycjami ustrojowymi głowy państwa Rzeczpospolitej Polskiej i głowy państwa Federacji Rosyjskiej na podstawie obecnie obowiązujących Konstytucji. Założeniem jest przedstawienie różnic, a także podobieństw pomiędzy wybranymi aspektami działalności tychże pozycji. Konkretne państwa zostały wybrane ze względu na podobny okres rozpoczęcia się transformacji ustrojowych i dwie różne drogi rozwoju omawianego urzędu, którymi podążyły. Rozdział pierwszy przedstawia porównanie, a także ogólny opis obu prezydentur. Podjęto próbę umiejscowienia ich w konkretnych pozycjach ustrojów państwowych poprzez analizę wybranych artykułów odpowiedniej Konstytucji. Następnie zostały przedstawione, scharakteryzowane i porównane wybory w obu krajach. Ostatni rozdział został poświęcony na analizę relacji łączących urząd prezydenta z poszczególnymi organami państwowymi. W przypadku Prezydenta Rzeczpospolitej Polskiej opisano jego relację z Sejmem i Senatem, Sądami i Trybunałami, a także Rządem i Administracją. Opisano również w sposób analogiczny relacje Prezydenta Federacji Rosyjskiej w z rosyjskimi organami państwowymi.
