Udział Prokuratora w postępowaniu administracyjnym

The topic of my text is "The Prosecutor's Participation in Administrative Proceedings". The first chapter presents the historical background based on the available sources and legal acts over the last hundred years in Poland, and describes the structure of organizational units of the prosecutor's office. The next chapter describes the rights and obligations of the prosecutor and his operation as a party, as well as the differences and similarities between him and other authorities. The chief prosecutor's office, ie the Public Prosecutor General, was also described. Then I focused on the prosecutor's powers, i.e. his right to initiate administrative proceedings, the right to participate in the proceedings and the right to participate in the pending administrative proceedings. The last chapter deals with the prosecutor's objection and its types, i.e. objection with a request for the invalidity of the decision, the resumption of the proceedings and the amendment or annulment of the decision. I mainly used the monograph of W. Czerwiński "The participation of the prosecutor in administrative proceedings". My work describes the prosecutor and the public prosecutor's office itself, but I focused mainly on the area of ​​prosecutor's activities in the field of administrative proceedings.

Tematem mojej pracy jest "Udział Prokuratora w postępowaniu administracyjnym". Pierwszy rozdział przedstawia tło historyczne w oparciu o dostępne źródła oraz akty prawne na przestrzeni ostatnich stu lat w Polsce, opisana została struktura jednostek organizacyjnych prokuratury. W kolejnym rozdziale opisane zostały prawa i obowiązki prokuratora oraz o jego działaniu na prawach strony, a także różnice i podobieństwa pomiędzy nim a innymi organami. Opisany został także naczelny organ prokuratury, tj. Prokurator Generalny. Następnie skupiłam się na uprawnieniach prokuratora, czyli o jego prawie do zainicjowania postępowania administracyjnego, prawie do udziału w postępowaniu oraz o prawie do udziału w toczącym się postępowaniu administracyjnym. Ostatni rozdział traktuje o sprzeciwie prokuratorskim oraz jego rodzajach, czyli sprzeciwu z żądaniem nieważności decyzji, wznowienia postępowania oraz zmiany lub uchylenia decyzji. W głównej mierze korzystałam z monografii W. Czerwińskiego "Udział prokuratora w postępowaniu administracyjnym". Moja praca opisuje prokuratora oraz sam organ, jakim jest prokuratura, przy czym skupiłam się głównie na sferze działań prokuratora w zakresie postępowania administracyjnego.
