The validity of the concept of administrative authority and criteria of validity of concepts in general

Artykuł dotyczy pojęcia organu administracji publicznej i jego aktualności we współczesnych kontekstach. Dynamika prawa administracyjnego sprawia, że wiele z pojęć służących do jego opisania i zrozumienia wymaga ciągłego sprawdzania i aktualizowania. Tak jest również w odniesieniu do kategorii ustrojowego prawa administracyjnego. Organ (pojęcie organu) jest określany przez swoje cechy charakterystyczne: instytucjonalne oraz funkcjonalne. Obecnie i z punktu widzenia instytucjonalnego przy określaniu zakresu organu wymaga uwzględnienia: systemowe rozumienie całego aparatu administracyjnego oraz kwestia legitymacji demokratycznej. Zaś z punktu widzenia funkcjonalnego jedyną odpowiedzią na współczesne konteksty jest nadanie funkcji administracyjnej nowego znaczenia. Tekst przedstawia także możliwe kryteria służące do oceny aktualności pojęć. Chodzi o użyteczność, adekwatność, funkcjonalność, systemowość (spójność zewnętrzną) oraz spójność wewnętrzną. Okazuje się także, że aktualność wpisana jest w istotę oceny danego pojęcia.

The paper presents the concept of administrative authority and the validity of this concept in actual contexts. The adminitrative law is very dynamic and many definitions of concepts that are used to describe and understand it must be updated. Also in the context of administrative structural law. The administrative authority is usually defined by its characteristic features both institutional and functional. Taking into consideration the institutional point of view when defining the scope of the administrative authority meanig: definig of the scope of administrative authority systemic meanig of the administrative apparatus and democratic legitimacy matter should be discussed. In current context, from the viewpiont of functionality, it is required that the administrative function shall be updated. The paper also discusses possible criteria used during assesment the validity of the legal concepts in general. This criteria are utility, adequacy, functionality, internal and external unity. It seems that validity is the core of the assesement of each concept.
