Research methods in the science of administration and the Fontes method

Założenia metody Fontes są ukierunkowane na badanie źródeł pochodzenia prawa, efektywności prawa i jego powiązań z normami innych rodzajów. Nie stoją w żaden sposób w opozycji do podejścia konwencjonalnego, wyznaczonego np. paradygmatem pozytywizmu prawniczego. Metoda ta nie neguje – a wręcz przeciwnie – czerpie z niego wiedzę niezbędną do osiągnięcia zasadniczego celu badań. Ponadto uzupełnia badania nad prawem i administracją o elementy, których nie dostarcza podejście konwencjonalne. Co więcej, badania nad materialnymi źródłami i efektywnością prawa pozostają w pełnej korelacji z podstawowymi założeniami pozytywizmu naukowego w ogóle. Chodzi bowiem o badanie konkretnych zjawisk społecznych. Nie chodzi o budowanie kolejnego systemu filozoficzno-prawnego, ale o poznanie faktów społecznych i charakteru relacji zachodzących pomiędzy faktami, co jest również jednym z celów nauki administracji jako takiej.

The assumptions of the Fontes method are focused on the study sources of origin of law, effectiveness of law and its links with other norms types. They are in no way in opposition to the conventional approach, determined, for example, by the paradigm of legal positivism. This method not only does not negate – on the contrary – it derives from it the knowledge necessary to achieve the main goal of research. In addition, it complements the study of law and administration with elements that the conventional approach does not provide. Moreover, research on the material sources and effectiveness of law is in full correlation with the basic assumptions of scientific positivism in general. It is about the study of specific social phenomena. It is not about building another philosophical-legal system, but about learning about social facts and the nature of the relations between facts, which is also one of the goals of learning administration as such.
