Skarga o uchylenie wyroku sądu polubownego

The subject of this work is an action for annulment of arbitration sentence. The first chapter presents general issues related to arbitration, as well as the legal nature, objectives and functions of an action for annulment of arbitration sentence. The second chapter is devoted to a detailed analysis of the scope of review of an arbitration award at the request of the parties filing an action to set aside the arbitration award. The subject of the last, third chapter is the grounds for complaint to set aside an arbitration award, considered ex officio, and in particular the contradiction of the arbitration award with the public policy.

Tematem niniejszej pracy jest skarga o uchylenie wyroku sądu polubownego. W rozdziale pierwszym przedstawiono zagadnienia ogólne dotyczące arbitrażu, a także charakteru prawnego oraz celów i funkcji skargi o uchylenie wyroku sądu polubownego. Rozdział drugi poświęcony został szczegółowej analizie zakresu kontroli wyroku sądu polubownego dokonywanej na wniosek stron wnoszących skargę o uchylenie wyroku sądu polubownego. Przedmiotem ostatniego, trzeciego rozdziału, są podstawy skargi o uchylenie wyroku sądu polubownego uwzględniane z urzędu, a w szczególności sprzeczność wyroku sądu polubownego z klauzulą porządku publicznego.
