Praktyczne problemy związane z procedurą wyłączania gruntów z produkcji leśnej;

Przedmiotem pracy jest analiza rozwiązań z zakresu ochrony ilościowej gruntów leśnych w Polsce. Celem pracy jest analiza stanu regulacji prawnej w zakresie ochrony ilościowej gruntów leśnych realizowanej przez reglamentację wyłączenia gruntów z produkcji leśnej. W rozdziale pierwszym wskazano jaki jest cel i charakter ochrony gruntów leśnych, scharakteryzowano ochronę lasów gruntów leśnych, a także zdefiniowano pojęcia lasu, gruntu leśnego, a także lasów ochronnych. Drugi rozdział poświęcony został omówieniu procedury zmiany przeznaczenia gruntów na cele nierolnicze i nieleśne oraz wyłączenia gruntów leśnych z produkcji. W rozdziale trzecim opisane zostały opłaty określane w decyzji zezwalającej na wyłączenie gruntu z produkcji leśnej. Należą do nich jednorazowa należność, opłaty roczne oraz jednorazowe odszkodowanie w razie dokonania przedwczesnego wyrębu drzewostanu, a także sposoby złagodzenia obciążeń finansowych związanych z wyłączeniem gruntu z produkcji leśnej. Należy do nich pomniejszenie należności o wartość gruntu, zwolnienie z opłat przy wyłączeniu na cele budownictwa mieszkaniowego oraz możliwość umorzenia całości lub części opłat na wniosek organu wykonawczego jednostki samorządu terytorialnego w przypadku inwestycji o charakterze użyteczności publicznej. Przedstawiono liczne praktyczne problemy wiążące się z tą tematyką. Ostatni rozdział dotyczy inwestycji realizowanych na gruntach leśnych z wyłączeniem zastosowania regulacji ustawy o ochronie gruntów rolnych i leśnych. Wynika to z uregulowań specustaw inwestycyjnych, mających na celu uproszczenie procedur przygotowania i realizacji inwestycji w zakresie obejmującym przedmiot danej ustawy specjalnej. Jedną z form uproszczenia procedur jest brak konieczności uzyskania decyzji zezwalającej na wyłączenie gruntu z produkcji leśnej oraz ponoszenia opłat z tego tytułu. Wnioski końcowe odnoszą się do problemu braku szczegółowych uregulowań postępowania wyłączenia gruntu z produkcji leśnej.

The subject of the thesis is to analyse the solutions in the field of quantitative protection of forest land in Poland. The aim of the study is to analyze the state of legal regulations in the field of quantitative protection of forest land by controlling the exclusion of land from forest production. The first chapter points out the purpose and nature of forest land protection, characterizes forest land protection, and defines the concepts of forest, forest land and protection forests. The second chapter describes the procedure of changing land use for non-agricultural and non-forest purposes and excluding forest land from production. Chapter three describes the fees specified in the decision authorizing the exclusion of land from forest production. These include a one-time payment, annual fees and one-off compensation in the event of premature felling of a forest stand, as well as ways to mitigate the financial burden related to excluding land from forest production. These include reducing the amount due by the value of the land, exemption from fees with the exception of housing construction purposes, and the possibility of remitting all or part of the fees at the request of the executive body of a local government in the case of public utility investments. A number of practical problems related to this subject were presented in this part of the thesis. The last chapter concerns investments carried out on forest land, with the exception of the application of the provisions of the Act on the Protection of Agricultural and Forest Land. This is due to the provisions of the special investment laws, aimed at simplifying the procedures for the preparation and implementation of investments in the scope covering the subject of a given special act. One of the forms of the procedures simplification is the lack of the need to obtain a decision authorizing the exclusion of land from forest production and not having to pay fees for this. The final conclusions refer to the problem of the lack of detailed regulations for the procedure of excluding land from forest production.
