Mowa nienawiści w orzeczeniach Europejskiego Trybunału Praw Człowieka

This thesis addresses hate speech in the case law of the European Court of Human Rights. The work begins with an analysis of the definition of hate speech in the literature and in the international law, and then presents the legal framework of hate speech binding for the European Court of Human Rights. The thesis also touches upon the regulation of hate speech on the grounds of the Polish legal system. The last chapter is devoted to the analysis of the most important rulings of the European Court of Human Rights regarding hate speech. The cited case law is divided according to the type of hate speech i.e., hate speech concerning racial, ethnic and religious discrimination and homophobic hate speech. Rulings concerning hate speech on the internet are also analysed.

Niniejsza praca porusza temat mowy nienawiści w orzeczeniach Europejskiego Trybunału Praw Człowieka. Praca rozpoczyna się analizą definicji mowy nienawiści w literaturze i w prawie międzynarodowym, a następnie przedstawia prawne uregulowania mowy nienawiści wiążące dla Europejskiego Trybunału Praw Człowieka. W pracy poruszony został także temat uregulowania zagadnienia mowy nienawiści na gruncie polskiego systemu prawnego. Ostatni rozdział poświęcony jest analizie najważniejszych orzeczeń Europejskiego Trybunału Praw Człowieka dotyczących mowy nienawiści. Przywoływane orzecznictwo podzielone jest ze względu na rodzaj mowy nienawiści, tj. mowę nienawiści dotyczącą dyskryminacji rasowej, etnicznej i religijnej i homofobiczną mowę nienawiści. Analizowane są także orzeczenia dotyczące mowy nienawiści w internecie.
