Amendment of a public contract as a result of an extraordinary increase in prices and liability for a breach of public finance discipline

Nadzwyczajne okoliczności i zdarzenia, których zaistnienie oraz rozmiar czy nasilenie były niemożliwe do przewidzenia – takie jak pandemia COVID-19, wojna w Ukrainie, katastrofy klimatyczne i ekologiczne – skutkują trudnościami w realizacji zawartych umów w sprawach zamówień publicznych . Zarówno zamawiający, jak i wykonawcy są zainteresowani zrealizowaniem udzielonego zamówienia, jednak często nie jest to możliwe na warunkach zawartych w umowie ze względu na znaczący wzrost kosztów. Przepisy Prawa zamówień publicznych zawierają instrumenty umożliwiające zamawiającemu dokonanie zmian umowy przy spełnieniu odpowiednich przesłanek , jednak w przypadku jednostek sektora finansów publicznych konieczne jest uwzględnienie upoważnienia do zaciągania zobowiązań określonego odpowiednio w ustawie budżetowej, uchwale budżetowej lub planie finansowym jednostki.

Extraordinary circumstances and events, the appearance and extent or intensity of which were unforeseeable, such as the Covid-19 pandemic, the war in Ukraine, climatic and environmental disasters, cause difficulties with the fulfilment of concluded public contracts. Both contracting authorities and contractors are interested in the fulfilment of the awarded contract, but this is frequently impossible on the terms of the contract because of a significant increase in costs. The provisions of the Public Procurement Law contain instruments enabling the contracting authority to amend the contract if the appropriate premises are satisfied, although, in the case of public finance sector entities, account needs to be taken of the authorization to incur the liabilities specified in the Budget Act, the budget resolution or the entity’s financial plan, respectively.
