Genocide and crimes against humanity in the light of public international law - substantive and institutional approach

W niniejszej pracy została omówiona problematyka zbrodni ludobójstwa oraz zbrodni przeciwko ludzkości w prawie międzynarodowym publicznym. W celu zrozumienia omawianego zagadnienia, zwrócono uwagę na kwestie materialnoprawne dotyczące zbrodni międzynarodowych oraz istotę funkcjonowania ponadnarodowego systemu wymierzania sprawiedliwości. Podjęto również refleksję nad ich prawnomiędzynarodowym, historycznym i socjologicznym znaczeniem. Rozdział pierwszy stanowi punkt wyjścia dla zrozumienia omawianego tematu, zawiera bowiem wprowadzenie do problematyki zbrodni międzynarodowych, w tym genezę powstania odpowiedzialności karnej jednostki za wskazane zbrodnie, wpływ utworzenia pierwszych międzynarodowych trybunałów wojskowych i karnych na proces kształtowania się odpowiedzialności karnej jednostki za nie, a także pojęcie terminu "zbrodni międzynarodowych". Zasadniczą część pracy stanowi omówienie zbrodni ludobójstwa oraz zbrodni przeciwko ludzkości, w tym zwrócenie uwagi na występujące między nimi zależności i podobieństwa, a także dokonanie ich analizy w oparciu o obowiązujące normy prawne, doktrynę i orzecznictwo międzynarodowych trybunałów wojskowych oraz karnych. W pracy poddano ponadto analizie, podstawowe zasad odpowiedzialności karnej jednostki za naruszenia norm dotyczycących zbrodni międzynarodowych, a także aspekty proceduralne i zasady procedowania przed Międzynarodowego Trybunału Karnego.

This thesis presents an analysis of genocide and crimes against humanity in public international law. To better understand the presented subject, the substantive legal aspects of international crimes and the essence of the functioning of the supranational justice system were highlighted. What is more, a reflection on the international, historical and sociological importance of the crimes is also examined. The first chapter marks the starting point for the presented topic, hence it provides an introduction to international crimes, including the genesis of the individual's criminal responsibility, the impact of the establishment of the first international military and criminal tribunals on its formation, as well as the concept of the term "international crimes." The core part of the thesis is a review of the genocide and crimes against humanity, regarding their correlations and similarities, as well as an analysis based on the legal standards, doctrine and jurisprudence of international military and criminal tribunals. In addition, the thesis analyzes, the basic principles of individual criminal liability, as well as procedural aspects and rules governing proceedings before the International Criminal Court.
