Insulting a monument in the context of the right of integrity of a work : an outline

Pomnik to obiekt, który wzniesiono dla uhonorowania osoby lub wydarzenia. Powiązany z nim ładunek aksjologiczny i emocjonalny sprawia, że nie tylko nie jest on neutralnym elementem przestrzeni publicznej, ale często staje się przedmiotem reinterpretacji w sposób nawet całkowicie sprzeczny z zamysłem fundatora. W polskim porządku prawnym określone przejawy "interakcji" z pomnikiem - m.in. modyfikacja kontekstu, w jakim się on znajduje - mogą być kwalifikowane jako jego znieważenie (art. 261 k.k.). Równocześnie za stworzeniem pomnika stoi konkretny twórca (lub twórcy). Warto więc przeanalizować, czy popełnienie czynu z art. 261 k.k. - ocenianego przez pryzmat aktualnych ram kulturowych, historycznych czy politycznych - może skutkować naruszeniem autorskich dóbr osobistych.

A monument is an object built to honour a person or commemorate an event. Due to axiological and emotional charge that is linked with a monument, such an object it is not a neutral element of the public space. Once erected, it can be reinterpreted, even in a manner which is quite contrary to the intention of its founder. It should be noted however, that according to art. 261 of the Polish Criminal Code certain forms of ‘interaction’ with a monument are treated as an insult and therefore penalized. Simultaneously, there is a particular author (or authors) behind the creation of the work. Thus, it is worthwhile to analyse whether committing an offence under Article 261 of the Polish Criminal Code - assessed from the perspective of the current cultural, historical or political framework - may result in an infringement of author’s moral rights.
