Death row phenomenon : definicja i analiza orzecznictwa

Praca poświęcona jest zagadnieniu „zjawisku celi śmierci’’ (death row phenomenon) jego definicji oraz analizy orzeczeń odnoszących się do tego problemu. W pierwszej części pracy zostanie przedstawiona definicja death row phenomenon oraz omówienie poszczególnych elementów jej tworzących. Następnie zostanie przedstawione orzecznictwo międzynarodowych organów sądowych jak i sądów krajowych, odnoszące się do problemu death row phenomenon, gdzie sądy te próbowały odpowiedzieć na pytanie : czy oraz pod jakim warunkiem/warunkami death row phenomenon narusza normy prawa międzynarodowego chroniące prawa człowieka jak i porządek prawny krajowy, w przypadku orzecznictwa sądów krajowych. Na koniec zostanie omówiona kwestia, czy możliwe jest żeby w prawodawstwie przewidującym karę śmierci, nie dochodziło do tego zjawiska.

The work is devoted to the issue of the "death row phenomenon,'' its definition and analysis of the rulings relating to this problem. The first part of the work will present the definition of death row phenomenon and discuss various elements constituting it. Then, the case law of international judicial bodies, as well as national courts relating to the problem of death row phenomenon will be presented, where these courts tried to answer the question : whether and under what conditions, the death row phenomenon violates the norms of international human protection rights, as well as the national legal order, in the case of national courts' case law. Finally, the work will discuss the question of whether it is possible that in legislation providing for the death penalty, this phenomenon does not occur.
