Niniejsza praca magisterska ma na celu zdiagnozowanie skuteczności organów nadzoru budowlanego i zidentyfikowanie perspektyw, które mają poprawić ich funkcjonowanie. W pierwszym rozdziale pracy zostaną objaśnione podstawowe pojęcia takie jak „skuteczność” oraz „nadzór”. W drugim rozdziale przedstawiona zostanie historia organów nadzoru budowlanego, która ma duży wpływ na obecny kształt nadzoru budowlanego. Ponadto omówiona zostanie struktura organizacyjna tych organów w celu lepszego poznania ich funkcjonowania. Kolejny obszar pracy skupia się na zadaniach i kompetencjach organów nadzoru budowlanego. W szczególności zostaną omówione ich obowiązki oraz uprawnienia nałożone przez ustawodawcę. Praca koncentruje się na głównych problemach ze skutecznością nadzoru budowlanego takich jak: niska wykrywalność samowoli budowlanych, niska wykonywalność decyzji rozbiórkowych, incydentalność stosowania wykonania zastępczego czy nieprawidłowe prowadzenie postępowań skargowych. Kolejny aspekt pracy będzie poświęcony zidentyfikowaniu przyczyn problemów ze skutecznością organów nadzoru budowlanego. Czynniki takie jak niedostateczne zasoby finansowe, problemy kadrowe, czy same przepisy prawne mają wpływ na efektywność organów nadzoru. W końcowej części pracy przedstawione zostaną zalecenia na przyszłość mające na celu poprawę skuteczności organów nadzoru budowlanego. Propozycje obejmować będą wzmocnienie zasobów finansowych, reorganizacja struktury nadzoru budowlanego oraz sprywatyzowanie niektórych ich zadań. Praca magisterska dostarcza kompleksowej analizy dotyczącej skuteczności organów nadzoru budowlanego. This master's thesis aims to diagnose the effectiveness of construction supervision authorities and identify perspectives that are to improve their functioning. In the first chapter of the work, basic concepts such as "effectiveness" and "supervision" will be explained. The second chapter will present the history of building supervision authorities, which has a large impact on the current shape of building supervision. In addition, the organizational structure of these bodies will be discussed to better understand their functioning. Another area of work focuses on the tasks and competences of construction supervision authorities. In particular, their duties and rights imposed by the legislator will be discussed. The work focuses on the main problems with the effectiveness of construction supervision, such as low detection of unauthorized construction, low execution of demolition decisions, incidental use of substitute performance or improper conduct of complaint proceedings. Another aspect of the work will be devoted to identifying the causes of problems with the effectiveness of building supervision authorities. Factors such as insufficient financial resources, staffing problems, or the legal regulations themselves affect the effectiveness of supervisory authorities. In the final part of the work, recommendations for the future will be presented to improve the effectiveness of building supervision authorities. The proposals will include strengthening financial resources, reorganizing the construction supervision structure and privatizing some of their tasks. The master's thesis provides a comprehensive analysis of the effectiveness of construction supervision authorities. The indicated recommendations may contribute to the effective performance of tasks by these authorities, which will improve the quality and safety of construction.
