Deception as a feature of the crime of rape

Według polskiego prawa karnego przestępstwo zgwałcenia polega na doprowadzeniu drugiej osoby do czynności seksualnych przy użyciu jednego z trzech środków: przemocy, groźby bezprawnej lub podstępu. Niniejsza praca skupia się na ostatnim z wymienionych, przybliżając zakres znaczeniowy pojęcia "podstępu", podając najważniejsze zagadnienia potrzebne dla jego zrozumienia. W dalszej części analizie poddane zostają różne stany faktyczne związane z problematyką znamienia podstępu, omówione są najciekawsze orzeczenia w tej kwestii, zarówno w prawie polskim, jak i zagranicznym, a w ostatnim rozdziale polskie rozwiązanie prawne porównane jest do rozwiązań w systemach innych państw.

According to Polish criminal law, the crime of rape consists in causing another person to engage in sexual activities using one of three means: violence, unlawful threat or deceit. This work focuses on the last of these, bringing the meaning of the concept of "deception" closer, giving the most important issues needed to understand it. In the further part, various cases related to the issue of the feature of deception are analyzed, the most interesting court decisions in this matter are discussed, both in Polish and foreign law, and in the last chapter the Polish legal solution is compared to solutions in the systems of other countries.
