Praca przybliża problematykę klauzul niedozwolonych w umowach deweloperskich oraz ochrony praw nabywcy jako słabszej strony umowy. Przedstawiono istotę umowy deweloperskiej, wzajemne zobowiązania stron, typowe postanowienia umowy, definicję i katalog typowych klauzul niedozwolonych stosowanych przez deweloperów oraz przykłady najczęściej stosowanych w nich abuzywnych zapisów umownych. Postanowienia umowne nieuzgodnione indywidualnie z nabywcą, naruszające w sposób sprzeczny z dobrymi obyczajami jego interesy nie wiążą go. Nabywcy posiadają szeroki wachlarz możliwości zmierzający do ochrony ich interesów.

The paper presents the issue of prohibited clauses in real estate development contracts and the protection of the rights of the purchaser as the weaker party to the contract. It presents the essence of a real estate development agreement, the mutual obligations of the parties, typical provisions of the contract, the definition, and a catalog of typical prohibited clauses used by developers, as well as examples of the most frequently used abusive contractual provisions in them. Contractual provisions that have not been individually agreed upon with the purchaser and that contradict good practices and their interests are not binding on the purchaser. Purchasers have a wide range of options aimed at protecting their interests.
