Video commentary and the right to quote within the meaning of Art. 29 of the Act on Copyright and Related Rights

Niniejsza praca ma na celu analizę zależności pomiędzy twórczością internetową na serwisie Youtube a prawem cytatu w rozumieniu artykułu 29 ustawy o prawie autorskim i prawach pokrewnych. W pracy przedstawiono sposób, w jaki autorzy filmów zamieszczanych na serwisie Youtube korzystają z cudzych utworów i czy robią to zgodnie z ustawą o prawie autorskim i prawach pokrewnych. Zostanie również ukazane podobieństwo form internetowych do form dziennikarskich, a także analiza art. 29 u.p.a.p.p. W części analitycznej pracy zostaną zestawione treści teoretyczne przedstawione we wcześniejszych rozdziałach wraz z przykładami wideokomentarz, wideorecenzji oraz wideoseju, zamieszczonych na serwisie Youtube.

This work aims to analyze the relationship between Internet creativity on YouTube and the right to quote within the meaning of Article 29 of the Act on Copyright and Related Rights. The paper presents how the authors of videos posted on YouTube use other people's works and whether they do so in accordance with the Act on Copyright and Related Rights. The similarity of online forms to journalistic forms will also be shown, as well as an analysis of art. 29 u.p.a.p.p. The analytical part of the work will summarize the theoretical content presented in the previous chapters along with examples of video commentary, video reviews and video essays posted on YouTube.
