The prosecutor’s office as an independent institution in a democratic rule of law

Praca magisterska posiada 6 rozdziałów. Celem niniejszej pracy jest analiza niezależności obecnie usytuowanej prokuratury w Polsce. W celu określenia pozycji ustrojowej prokuratury zbadano przepisy stanowiące podstawę jej usytuowania. Rozważania te stanowią niezbędną bazę do pracy nad najistotniejsza kwestią tej pracy. Niezależność rozpatrzono w ujęciu wewnętrznym organu prokuratury oraz zewnętrznym w stosunku do organów pozaprokuratorskich. Wraz z kolejnymi konsekwencjami przyjętych rozwiązań prawnych oraz opiniami środowisk prawniczych, wyłania się obraz obecnej prokuratury i czynników jakie wpływają na kształt tej instytucji.

The thesis contains 6 chapters. The goal of this study is to analyze the independence of the prosecution office currently situated in Poland. In order to determine the systemic position of the prosecutor's office, the rules that define its role and position in the system. These thoughts serve as the necessary groundwork for addressing the main focus of this study. I have considered the independence both from within the prosecution office and from an external standpoint in relation to non-prosecutorial bodies. Alongside the subsequent consequences of the adopted legal solutions and the opinions of the legal community, a picture of the current prosecution system emerges and the factors that influence the shape of this institution emerges.
