Permissible scope of restriction of rights and freedoms of detainees in centers for dangerous offenders

This master's thesis focuses on analyzing the operation of the Gostynin Center, established under the Law of November 22, 2013 regarding the treatment of persons with mental disorders who pose a threat to the life, health or sexual freedom of other individuals. The purpose of the study is to evaluate the activities of the Center, with an emphasis on the observance of the rights and freedoms of patients within the framework of the National Center for the Prevention of Dyssocial Behavior (KOZZD). The first chapter will discuss the organization and functioning of the National Center for the Prevention of Dyssocial Behavior in Gostynin, covering the genesis of its establishment and the objectives of the legislature related to this institution. The second chapter will be devoted to an analysis of the compatibility of the various points of the Center's rules of procedure with international law and the Constitution. The third chapter will compare the Gostynin Center with the Rosdorf facility, emphasizing common rights and freedoms, as well as differences in the staff's approach to people placed in the two centers.

Niniejsza praca magisterska skupia się na analizie funkcjonowania Ośrodka w Gostyninie, ustanowionego na mocy ustawy z dnia 22 listopada 2013 r. dotyczącej postępowania wobec osób z zaburzeniami psychicznymi stanowiących zagrożenie dla życia, zdrowia lub wolności seksualnej innych jednostek. Celem badania jest ocena działań Ośrodka, z naciskiem na przestrzeganie praw i wolności pacjentów w ramach Krajowego Ośrodka Zapobiegania Zachowaniom Dyssocjalnym (KOZZD). W pierwszym rozdziale omówiona zostanie organizacja i funkcjonowanie Krajowego Ośrodka Zapobiegania Zachowaniom Dyssocjalnym w Gostyninie, obejmując genezę powstania oraz cele ustawodawcy związane z tą instytucją. ozważane będą procedury przyjęcia do ośrodka oraz jego kluczowe funkcje.RRozdział drugi poświęcony będzie analizie zgodności poszczególnych punktów regulaminu wewnętrznego Ośrodka z prawem międzynarodowym i Konstytucją. W trzecim rozdziale nastąpi porównanie Ośrodka w Gostyninie z placówką w Rosdorf, przy akcentowaniu wspólnych praw i wolności oraz różnic w podejściu personelu do osób umieszczonych w obu ośrodkach.
