Vehicle forfeiture is unconstitutional : courts should not take cars from drivers

On 14 March 2024, the forfeiture of vehicles, adopted by the Sejm on 7 July 2022, entered into force. The provisions introduced into the Criminal Code flagrantly violate the Constitution, both in their content and in the way they were enacted. Inequality before the law, disproportionality, tying the hands of the courts, unconstitutional provision defining the date of entry into force of the amendment. All this makes it clear that car confiscation should not be applied.

14 marca 2024 r. zaczął obowiązywać przepadek pojazdów, przyjęty w Sejmie 7 lipca 2022 r. Przepisy wprowadzone do Kodeksu karnego rażąco łamią Konstytucję: co do meritum i co do trybu ich uchwalenia. Nierówność wobec prawa, nieproporcjonalność, związanie rąk sądowi, niekonstytucyjny przepis określający dzień wejścia w życie nowelizacji. To wszystko sprawia, że przepadek auta nie powinien być stosowany.
