Skład sądu w postępowaniu apelacyjnym po nowelizacji KPC z 7.7.2023 r., czyli o cywilnoprocesowym węźle gordyjskim i pomysłach na jego rozwiązanie

Artykuł stanowi krytyczną analizę zagadnienia składu sądu w postępowaniu apelacyjnym po zmianach wprowadzonych na mocy nowelizacji Kodeksu postępowania cywilnego z 7.7.2023 r. z uwzględnieniem ewolucji funkcjonujących w tym zakresie rozwiązań w okresie obowiązywania tego kodeksu. Zwieńczeniem artykułu jest ocena obowiązującej regulacji wraz z propozycją rozwiązań bardziej optymalnych z punktu widzenia wyważenia kolidujących interesów i wartości realizowanych przez konkurujące zasady kolegialności i jednoosobowości orzekania przed sądem II instancji.

The article provides a critical analysis of the issue of the composition of the court in appellate proceedings after the changes introduced by the amendment to the Code of Civil Procedure of 7 July 2023, taking into account the evolution of solutions in this area during the period in which the Code has been in force. The article concludes with an assessment of the current regulation along with a proposal of more optimal solutions from the point of view of balancing conflicting inter-ests and values realised by the competing principles of collegiality and adjudication by a one-judge panel in the court of second instance.
