Stan cywilny czy tożsamość jako dobro osobiste

Personal interest involves all personal non-property rights that are widely accepted by society which make up a person’s mental and physical integrity, and which determine that integrity, as well as the effects of human creative activity. Personal interest determines human identity, as well as one’s standing in society, and intangible ties with other people and with one’s own work. The catalogue of personal interests is open. Science proposes that human marital status be one of them yet the scope of this term is disputable in the context of the marital status and family law. Za dobra osobiste uważa się wszelkie przynależne człowiekowi wartości niemajątkowe, akceptowane powszechnie w społeczeństwie, składające się na jego psychiczną i fizyczną integralność i o niej decydujące oraz efekty działalności twórczej człowieka. Określają one tożsamość człowieka, jego pozycję w społeczeństwie oraz niematerialne więzi z innymi ludźmi i jego własnym dziełem. Katalog dóbr osobistych jest otwarty. Nauka proponuje umieszczenie nim stanu cywilnego, ale zakres tego pojęcia w kontekście unormowań prawa o aktach stanu cywilnego i rodzinnego budzi wątpliwości. Wąsko rozumiany stan cywilny nie ma cech dobra osobistego, za które można uważać „stan osobisty” albo „tożsamość własną” człowieka.
