Legal forms of applying the institution of direct democracy at the level of the auxiliary units of communes

The article analyses the issue of real possibility to participating society in exercising authority at closest level to the citizen - auxiliary units of communes. In this thesis author are trying to answer the question whether the current legal regulations create applicable foundation for social activation and its direct participation in creating state policy. Author by basing on dogmatic method and supporting it by historical analysis come to conclusion that the issue is highly varied across the country although polish legislator creates basis for institution which allows to realize assumptions of direct democracy. Moreover author in thesis presents postulates which can be used to develop social participation at this level.

Artykuł porusza problematykę realnej możliwości udziału społeczeństwa w sprawowaniu władzy na poziomie jednostek najbardziej zbliżonych obywatelowi - jednostek pomocniczych gmin. W pracy autor stara się odpowiedzieć na pytanie, czy obecne regulacje prawne tworzą odpowiedni fundament pod aktywizację społeczeństwa i jego bezpośredni udział w kształtowaniu polityki państwa. Opierając się na metodzie dogmatycznej, a także wspierając ją analizą historyczną, autor jednoznacznie stwierdza, że mimo iż kwestia ta w skali kraju jest wysoce zróżnicowana, to ustawodawca polski tworzy swoisty szkielet instytucji pozwalającej na realizację założeń demokracji bezpośredniej. Ponadto w pracy tej przedstawione zostały postulaty mogące służyć rozwojowi partycypacji społecznej na tym właśnie poziomie.
